SYNTHORA Machine Services — Terms of Service & Abuse Policy
Version 1.0 · Effective 2026-09-03 · Applies to all machine-payable API endpoints under *.hergertsynthora.com (the "Service"), settled per call via the x402 protocol in USDC on Base (eip155:8453).
1. The service, as is
The Service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Outputs are data intelligence, scores and technical verdicts: they are not financial, investment, legal or professional advice. Decisions made from them remain solely the caller's. A best-effort machine SLA (uptime target, measured latency, schema policy) is published at /sla.
2. Pay-per-call. No refunds once delivered
Each call is paid individually via x402 in USDC on Base. A payment is non-refundable once the response has been delivered. If a paid result cannot be produced, the call is not settled: you are not charged for undelivered output. The on-chain transaction hash is the invoice and proof of payment; a human-readable invoice citing the tx hash is available on request (see §7).
3. Acceptable use — abuse policy
- No targeting third parties without verifiable authorization. Any assessment, scan, audit or lookup against infrastructure you do not own requires prior verifiable proof of control or written authorization (e.g. DNS TXT / meta-tag challenge under
_synthora-auth.<domain>). Without verification there is no execution — even if paid; unsettled calls are not charged. - Security assessment outputs (v1) are passive only: OSINT, public exposure and header/configuration review. No intrusive techniques against third-party assets. Intrusive work happens only in our own lab.
- No use of the Service to violate law or third-party rights; no denial of service, no exfiltration of third-party data, no harassment, no evasion of sanctions.
- Abuse, or payment screening failure, results in refusal of service and may be reported to the payment facilitator.
4. Sanctions screening (OFAC / KYT)
Payments are screened by the x402 payment facilitator (Coinbase CDP), including OFAC sanctions and know-your-transaction (KYT) checks. Calls whose payment fails screening are rejected by the facilitator and are never settled. We do not operate bank KYC: the Service is wallet-native and machine-native.
5. Data and privacy
We log the minimum needed to operate: request payloads necessary to produce the result, the payer address, and the settlement transaction hash. We do not sell request data. Deletion requests for off-chain stored artifacts are honored on request.
6. Liability
To the maximum extent permitted by applicable law, liability is limited to the amount paid for the specific call giving rise to the claim. No liability for indirect or consequential damages.
7. Invoices
The x402 settlement transaction on Base is the invoice. For humans who need a document, a PDF invoice citing the transaction hash is issued on request at info@hergertsynthora.com.
8. Changes and jurisdiction
These terms may be updated; the version served at this URL at the time of the call applies. Governing jurisdiction: pending designation by the operator (item G7). This clause will be updated without further notice once designated.
